Website and Expedition Planner Terms

Use at your own risk
The Expedition Planner is an automated planning aid. It is not advice, a safety assessment, approval or certification. Remote and expedition travel can cause serious injury, death, delay and property loss. You remain responsible for every decision.
Who provides the service
The website and Expedition Planner are provided by Aaron Hudson trading as Breakstate, ABN 63 596 998 005, Australia. In these terms, “Breakstate”, “we” and “us” refer to that business.
Acceptance and eligibility
By using the website or generating, saving, sharing or downloading a Plan, you agree to the version of these terms shown when you accepted them. You must be at least 18 years old and legally able to accept these terms. If you use the service for someone else, you must have authority to do so and must give them these warnings and terms.
What the Planner does
The Planner uses the information you supply, programmed rules and third-party information to produce a working planning record. It may identify questions, checks or possible actions. It does not inspect you, your party, vehicle, equipment, route or conditions, and it does not determine whether you are competent, prepared or safe to proceed.
A Plan may be incomplete, inaccurate, outdated or unsuitable for your circumstances. An absence of a warning does not mean that a risk is absent.
Your responsibility
You decide whether to depart, continue, alter or abandon a trip. You are responsible for route choice, skills, health, party capability, vehicle condition, equipment, fuel, water, weather, communications, permits, insurance, laws, emergency preparation and all use of a Plan.
Before relying on critical information, verify it independently with current authoritative sources, relevant authorities, qualified professionals, manufacturers and service providers.
No monitoring or emergency service
Breakstate does not monitor your trip, location, progress, messages, weather or changing conditions. The service is not live navigation, guided travel, emergency monitoring, rescue, dispatch or an Overwatch service. Using a Plan does not create a duty for Breakstate to warn, contact, monitor or assist you.
Third-party information and services
Maps, routes, places, forecasts, operating hours, links and other third-party information can change without notice. Breakstate does not control those providers and does not guarantee their availability or accuracy. Google Maps Platform features are also subject to the Google Maps Platform Terms of Service.
Saved and shared Plans
A claimed Plan is attached to the email account you verify through a one-time sign-in link. Keep access to that email secure and tell us promptly if you believe someone else has accessed your account. Breakstate claims only the Plan named in that verification flow; another Plan created with the same submitted email is not automatically added to the account.
Legacy private Plan links and read-only shared links may continue to work for their stated period. Anyone with a valid link may be able to open that Plan, so keep links secure and share them only with people you trust. Recipients must conduct their own checks; sharing a Plan does not transfer your responsibility or make Breakstate responsible to the recipient.
Expedition Pass during early access
An Expedition Pass applies to one saved expedition. During early access it is included at $0 for 120 days from activation. No card is required, it is not a free trial, it does not renew automatically and activation does not authorise Breakstate to charge you later.
While the Pass is active, it covers normal use of that expedition, including rewrites, route, weather and fuel refreshes, and exports, subject to reasonable fair-use and abuse controls. Breakstate may limit automated or excessive use that threatens the service or other customers.
When the active period ends, the claimed Plan does not disappear: it remains readable and downloadable through the verified account. Any later extension is a separate, explicit choice under the offer and terms shown at that time. Moving from early access to paid activation will not unexpectedly remove an Expedition Pass already activated under this version.
Permitted use
You may use a Plan for your personal planning. You must not resell the Planner or a Plan, remove warnings, misrepresent a Plan as professional approval, interfere with the service, or use it unlawfully. Breakstate retains its rights in the website, software, framework, presentation and module system; your own information remains yours.
Availability and changes
The website and Planner are provided on an “as available” basis. We may correct, change, suspend or withdraw features, and we do not promise uninterrupted access or that a previous Plan remains current. Breakstate will not delete a claimed Plan merely because its Expedition Pass active period ends, but may still retain or delete records to comply with law, respond to a deletion request, protect the service or close the service. Keep your own downloaded copy of anything you may need in the field. Changes to these terms apply prospectively; the dated version accepted for an existing saved Plan remains the record of that acceptance.
Expedition Design Reviews
A paid Expedition Design Review is a separate, limited human review governed by the versioned Design Review Terms accepted when booking.
Consumer rights and liability
Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded. Where liability can lawfully be limited, Breakstate’s liability is limited to the maximum extent permitted by law. Breakstate is not responsible for expedition outcomes or for loss caused by decisions, omissions, changing conditions, incorrect user information, third-party information or use contrary to these warnings.
Governing law
These terms are governed by the laws applicable in Australia. Subject to any mandatory right you have under applicable law, the parties submit to the courts exercising jurisdiction in Australia. This clause does not remove a protection or forum right that cannot lawfully be excluded in your location.
