A limited trip-plan review. Not a safety certification.

The Review is provided by Aaron Hudson trading as Breakstate, ABN 63 596 998 005, Australia.

An Expedition Design Review is a limited human review of the trip plan and information you provide. It includes a booked 45-minute video call and a written Expedition Readiness Report recording observations, questions and prioritised actions arising within that scope and time.

It is not an inspection, audit, approval, certification, assurance or guarantee. It does not promise a minimum number of findings, discovery of every risk, customer satisfaction or any expedition outcome.

The Review depends on the accuracy and completeness of what you provide. Breakstate may misunderstand information, miss relevant matters, or lack information that later becomes important. Conditions and third-party information can change after the Review. The Report addresses the Plan reviewed at that time; later changes to the mission, route, party, vehicle, equipment or conditions may make observations inapplicable.

You remain responsible for your route, skills, health, party, vehicle, equipment, permits, communications, fuel, water, weather, insurance, emergency preparation and whether to depart, continue, alter or abandon the trip. You decide whether and how to implement any observation. You must independently verify critical information with current authoritative sources, qualified professionals, authorities, manufacturers and providers.

Breakstate does not supervise implementation, inspect physical work, monitor the trip or assume responsibility for your actions. The Review is not guided travel, live navigation, emergency monitoring, rescue support, or medical, legal, engineering, mechanical or other regulated professional advice.

Breakstate will provide the booked Review and written Report. If either is not delivered, you may choose another appointment or a refund of the Review fee. You may email reasonable questions for 30 days after delivery. During that period, Breakstate will correct factual or reporting errors and provide one reasonable follow-up review concerning the Plan originally reviewed. A materially different Plan requires a new booking.

The full fee is payable when paid booking is activated. The cancellation policy accepted when booking governs cancellation, rescheduling and non-attendance. If Breakstate cancels, you may choose another appointment or a full refund. Read the Cancellation Policy.

The Review is recorded and transcribed to prepare and quality-check the Report and cannot proceed without every participant’s express consent. Breakstate asks you to accept the completed Report. The audio recording is scheduled for deletion 30 days after acceptance. The transcript, final Report and restricted working records may be retained for legal, operational and quality purposes as described in the Privacy Notice.

Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded. Where liability can lawfully be limited, Breakstate’s liability is limited to the maximum extent permitted by law. Breakstate is not responsible for expedition outcomes or losses caused by decisions, implementation, omissions, changing conditions, inaccurate or incomplete user information, or third-party information.

These terms are governed by the laws applicable in Australia. Subject to any mandatory right you have under applicable law, the parties submit to courts exercising jurisdiction in Australia. This does not remove a protection or forum right that cannot lawfully be excluded in your location.

The dated legal version accepted at booking governs that booking. Later terms apply only to later bookings and do not retrospectively reduce the agreed rights or obligations.
